Multitouch isn't really a vital feature so Google don't want to risk it. Honestly, I can't believe that any massive computer corporation is stupid enough to believe any court will believe their claim of "we invented multitouch" which Apple didn't (Microsoft started with multitouch tablets ages before the iPhone; Synaptics make multitouch touchpads all the time) and "we invented multitouch zooming.
