Samsung seeks injunction against banned Galaxy Tab 10.1 sales in Australia

Uh oh, Samsung’s being a poor sport. The company is appealing the Galaxy Tab 10.1 ban in Australia. This comes two weeks after a court ruled in favor of Apple effectively preventing all sales of the tablet in the country/continent for infringing on Apple’s patents. The evidence it presented in court regarding Samsung’s two patent infringements was enough to convince Justice Annabelle Bennett. Neil Young, the lawyer representing Samsung for this case, backed up the move to appeal the ban in Australia, saying the judge “made errors of law in her approach.”

A successful injunction is crucial for Samsung, especially with the holiday season just around the corner. No Galaxy Tab 10.1 in Australia means a considerable loss in profit; in fact, this is supposedly so detrimental that Samsung may not be able to release the tablet at all in Australia if it’s not available for the holidays.

Ongoing legal battles between Apple and Samsung have made the news for most of 2011, and there are still a number of active lawsuits in certain countries around the world. The most recent is Samsung’s attempt to get the new iPhone 4S banned in Australia, France, Japan, and Italy for — this may come as a surprise — patent infringements. So far, Apple has been the most successful in taking Samsung’s competing products off the market for reasons apparently good enough for the courtroom.
