Qualcomm dealt another blow in ITC import ban case – court denies Qualcomm’s request to delay ban

Qualcomm logoQualcomm just doesn’t seem to be able to catch a break these days. We can’t say we’re sorry for the company – afterall, it’s their (and Broadcom‘s) juvenile negotiation tactics that got them into this whole mess. The U.S. Court of Appeals for the Federal Circuit denied Qualcomm’s appeal for a delay of the International Trade Commission (ITC) ruling to ban the import of Qualcomm’s 3G chipsets. Apparently, the court will not have jurisdiction of the case until the Presidential review period has expired – August 6th marks the end of the 60-day review.

The denial comes on the heels of Verizon Wireless’s backdoor deal with Broadcom to directly license the power-saving 3G technology that’s at the heart of this situation. Verizon Wireless also withdrew it’s support of Qualcomm’s appeals.

Will the presidential review result in a veto? Will Qualcomm bow to Broadcom’s demands? What will happen next? Stay tuned for the next episode of “Qualcomm v. Broadcom – The Juvenile Years.” We love the drama!
